Do you have a motorcycle accident claim in NSW?
Riders and pillion passengers injured in a motor vehicle accident in NSW can claim statutory benefits regardless of who was at fault. Family members of someone seriously or fatally injured may also have a claim.
Every registered vehicle in NSW carries Compulsory Third Party (CTP) “Green Slip” insurance, and that’s what your claim is made against. It doesn’t matter if the other driver was uninsured, unidentified or fled the scene – you can still make a claim, including through the Nominal Defendant scheme in hit-and-run or uninsured vehicle cases.
If you’re not sure whether you have a claim, we encourage you to fill out our online claim check form and a lawyer will review your situation at no charge. You can also call our office to speak with someone.

What compensation can I claim after a motorcycle accident?
-
Weekly income payments
For lost earnings while you’re unable to work
-
Medical and treatment expenses
Doctors, physiotherapy, hospital care, and rehabilitation
-
Pain and suffering (non-economic loss)
Compensation for the physical and emotional impact of your injury, in eligible claims
-
Past and future loss of income and earning capacity
Income you’ve lost so far, and the impact on your ability to earn in the future, in eligible claims
A CTP claim covers injuries to people. Damage to your motorcycle, helmet and riding gear is a separate matter – ask us during your case assessment and we’ll point you in the right direction.
What you’re entitled to depends heavily on how your injuries are classified and who was responsible. Our lawyers can give you a realistic picture of your position after an initial assessment.
What if the insurer says I am not entitled to ongoing benefits but I believe I am?
This is not uncommon, as insurers will aim to minimise their expenses.
The assessment by the insurer on a threshold injury is not conclusive. You are entitled to challenge the assessment by the insurer and Whitelaw McDonald Lawyers has successfully challenged a number of threshold decisions which have resulted in continuing benefits for clients and an entitlement to pursue common law damages for loss of earnings. To ensure you are given the best chance of receiving ongoing benefits beyond the first 52 weeks it is best to get advice well before the insurer issues their decision so that the claim can be properly assessed and the necessary medical evidence can be obtained.

Motorcycle accidents we help with
No two accidents are the same, and you don’t need a straightforward case to have a motorbike accident claim. We regularly help riders and passengers who were injured:
- When another driver failed to give way, pulled out or turned across their path
- When they were rear-ended while stopped or slowing
- When they were forced off the road or off their bike by another vehicle
- By a vehicle that didn’t stop (hit-and-run)
- In slides and falls caused by another road user
- In lane-splitting or lane-filtering incidents
- In a single-vehicle accident with no other vehicle involved – for example, losing control on a wet road
- As a pillion passenger
- While riding for or commuting to work

“[…] Once my legal team became involved, a large burden was lifted. They managed all communication with the insurer and assessors, explained each step clearly, and ensured my focus remained on recovery rather than administrative stress.
Overall, while the aftermath of the crash was one of the hardest times in my life, I would strongly recommend that anyone going through a similar CTP process seek professional legal guidance early — it makes a significant difference both practically and emotionally.”

Time limits after a motorbike accident – don’t wait
Motor vehicle accident claims in NSW run on strict timeframes, and missing them can cost you money you’re otherwise entitled to.
-
Within 28 days
Report to police within 28 days
Make sure you get a police event number. You’ll need it for your claim.
-
Within 28 days
Notify the CTP insurer within 28 days
Do this if you want your statutory benefits backdated to the day after the accident. You can still lodge later, but you may lose entitlement to backdated weekly payments.
-
Within 3 months
Lodge your claim within 3 months of the accident at the latest
After that, you’ll need to provide a full and satisfactory explanation for the delay, and the insurer may refuse to accept it.
These are general time limits. Individual circumstances can change the outcome, so it’s best to get advice as early as you can.
The earlier you get advice, the more of your entitlement you protect. If you’re reading this some time after your accident, don’t assume it’s too late – get in touch and we’ll tell you exactly where you stand.
What if I was partly at fault, or no other vehicle was involved?
Fault isn’t always obvious straight after a motorcycle accident, and it can be disputed. A disagreement with the insurer is fairly common and isn’t the end of your claim.
Everyone is entitled to statutory benefits for the first 52 weeks regardless of fault. Whether you can also make a common law damages claim depends on the degree of fault and the severity of your injuries. Our team can assess this for you. If you came off your bike and no other vehicle was involved, you may still have entitlements.
What if the driver didn’t stop, or the vehicle was uninsured?
You can still make a claim. NSW’s Nominal Defendant scheme covers accidents involving uninsured or unidentified vehicles, including hit-and-run accidents, and we can guide you through the process.
Evidence can matter in these cases. Any CCTV, dashcam or helmet-camera footage, and the details of anyone who saw what happened, can help.
