Hit by a car, ute, truck or motorcycle while riding a bicycle or e-bike in New South Wales? Our team can take over your claim for injury compensation through CTP insurance – the insurance every registered vehicle in NSW must carry, sometimes called a “Green Slip.”
Bicycles, e-bikes and e-scooters do not carry CTP insurance themselves. This means you cannot make a CTP claim simply because you have been involved in a collision with a bicycle or e-bike. This page explains what to do if you are injured while riding a bicycle or e-bike after being hit by a motor vehicle that is covered by CTP insurance, such as a car, truck or motorcycle.
Riders have very little protection in a collision, and a serious injury can mean months of treatment and time away from work. Regardless of the severity of your case, it’s always worth getting a legal opinion on your situation. We’ll tell you plainly whether you have a claim and what happens next.
Whitelaw McDonald has been proudly representing injured riders across New South Wales for over 40 years – beginning in Newcastle, and growing to cover Sydney, the Central Coast, Coffs Harbour, Wollongong and beyond. Free advice is available and there is no obligation to proceed.

Can I claim if I was hit while riding a bike or e-bike?
Cyclists and e-bike riders injured by a motor vehicle in NSW can claim statutory benefits regardless of who was at fault. Family members of someone seriously or fatally injured may also have a claim.
Every registered vehicle in NSW carries Compulsory Third Party (CTP) “Green Slip” insurance. This is what your claim is made against, specifically the CTP insurer of the vehicle that struck you. It doesn’t matter if the driver was uninsured, unidentified or fled the scene – you can still make a claim, including through the Nominal Defendant scheme in hit-and-run or uninsured vehicle cases.
If you’re not sure whether you have a claim, we encourage you to fill out our online claim check form and a lawyer will review your situation at no charge. You can also call our office to speak with someone.
Does a motor vehicle have to be involved?
Yes. CTP is the scheme for people injured in motor vehicle accidents, so your claim generally depends on a car, ute, truck or motorcycle having struck you.
If no vehicle was involved, a CTP claim isn’t available. For example, if you came off your bike after hitting a pothole, losing control or slipping on a wet road, that isn’t classed as a motor vehicle accident covered by CTP.
If a vehicle caused your crash without hitting you, for example a driver opened a car door into your path or forced you off the road, it’s worth getting advice on your situation.
Bicycle and e-bike accidents we help with
We have seen cycling accident claims in several forms. A few examples of how riders were injured includes:
- When a driver failed to give way, pulled out or turned across their path
- When they were hit from behind
- In a bike lane, on the road shoulder or at an intersection
- By a vehicle that didn’t stop (hit-and-run)

What compensation can I claim after a bicycle or e-bike accident with another vehicle?
-
Weekly income payments
For lost earnings while you’re unable to work
-
Medical and treatment expenses
Doctors, physiotherapy, hospital care, and rehabilitation
-
Pain and suffering (non-economic loss)
Compensation for the physical and emotional impact of your injury, in eligible claims
-
Past and future loss of income and earning capacity
Income you’ve lost so far, and the impact on your ability to earn in the future, in eligible claims
What you’re entitled to depends heavily on how your injuries are classified and who was responsible. Our lawyers can give you a realistic picture of your position after an initial assessment.
What if I was partly at fault?
Fault isn’t always obvious straight after a crash, and being partly at fault doesn’t automatically rule you out.
Everyone is entitled to statutory benefits for the first 52 weeks regardless of fault. Whether you can also make a common law damages claim depends on the degree of fault and the severity of your injuries. Our team can assess this for you.

“[…] Once my legal team became involved, a large burden was lifted. They managed all communication with the insurer and assessors, explained each step clearly, and ensured my focus remained on recovery rather than administrative stress.
Overall, while the aftermath of the crash was one of the hardest times in my life, I would strongly recommend that anyone going through a similar CTP process seek professional legal guidance early — it makes a significant difference both practically and emotionally.”

Time limits after being hit by a vehicle – don’t wait
-
Within 28 days
Report to police within 28 days
Make sure you get a police event number. You’ll need it for your claim.
-
Within 28 days
Notify the CTP insurer within 28 days
Do this if you want your statutory benefits backdated to the day after the accident. You can still lodge later, but you may lose entitlement to backdated weekly payments.
-
Within 3 months
Lodge your claim within 3 months of the accident at the latest
After that, you’ll need to provide a full and satisfactory explanation for the delay, and the insurer may refuse to accept it.
These are general time limits. Individual circumstances can change the outcome, so it’s best to get advice as early as you can.
The earlier you get advice, the more of your entitlement you protect. If you’re reading this some time after your accident, don’t assume it’s too late – get in touch and we’ll tell you exactly where you stand.
A workers compensation claim has its own separate time limits.
What if the driver didn’t stop, or the vehicle was uninsured?
You can still make a claim. NSW’s Nominal Defendant scheme covers accidents involving uninsured or unidentified vehicles, including hit-and-run accidents, and we can guide you through the process.
Evidence can matter in these cases. Any CCTV or dashcam footage, the details of anyone who saw what happened, and anything you or a family member can recall about the vehicle can help.

Frequently Asked Questions
A CTP claim covers injuries to people. Damage to your bike, e-bike, helmet and other gear is a separate matter. You may be able to claim through your own insurance or from the driver’s insurer, so ask us during your case assessment and we’ll point you in the right direction. Keep your damaged gear, take photos and hold on to receipts.
Generally, yes. Cyclists injured by a motor vehicle in NSW are covered under the same CTP scheme as drivers and passengers, and are entitled to statutory benefits and, where appropriate, a common law claim. Get in touch for a free assessment of your specific situation.
Generally, yes. If a car, ute, truck or motorcycle struck you while you were riding an e-bike, the same CTP rules apply as for a bicycle. If you’re unsure how your e-bike is classified or how the accident happened, get in touch and we’ll tell you where you stand.
Yes. CTP is the scheme for people injured in motor vehicle accidents, so a CTP claim generally depends on a car, ute, truck or motorcycle having struck you.
A CTP claim generally isn’t available if no motor vehicle was involved. Other claims, such as public liability, may be possible if a poorly maintained road or path caused your crash.
You can still make a claim. NSW’s Nominal Defendant scheme covers accidents involving uninsured or unidentified vehicles, including hit-and-run accidents.
Yes. Everyone is entitled to statutory benefits for the first 52 weeks regardless of fault. Whether you can also make a common law damages claim depends on the degree of fault and the severity of your injuries – we can assess this for you.
Everyone injured in a motor vehicle accident is entitled to statutory benefits for the first 52 weeks, covering lost income and medical expenses, regardless of fault. If you weren’t mostly at fault and your injuries meet the criteria, you may also be entitled to a common law damages claim covering pain and suffering, and loss of earning capacity.
“Threshold” injuries are essentially the injuries classified as minor under the NSW CTP scheme. Statutory benefits for a threshold injury generally stop at 52 weeks, and a common law claim generally isn’t available. How your injury is classified can have a big effect on your entitlements, so it’s worth getting advice if you’re unsure.
Yes. You generally need to report the accident to police within 28 days, notify the CTP insurer within 28 days to have your statutory benefits backdated, and lodge your formal claim within 3 months. After 3 months, you’ll need to explain the delay to the insurer. Claims for lump sum compensation have their own time frames, so it’s best to get advice as early as possible.
Yes. You’ll need a police event number for your CTP claim.
No. CTP covers injuries to people, not damage to your bike or gear. Ask us and we’ll point you in the right direction.
We act on a No Win, No Fee basis for motor vehicle accident claims. You don’t pay us unless we win your claim. We’ll explain exactly how costs work for your situation during your free initial consultation.
It depends on the complexity of your injuries and whether liability is disputed. Straightforward statutory benefits claims can be resolved within months, while common law damages claims involving more serious injuries typically take longer, and most are resolved through negotiation rather than court.
Family members of someone fatally injured may also have a claim.
