Have you been the victim of domestic violence and suffered a physical or psychological injury?

In a NSW Court of Appeal case, a man assaulted his partner by pushing her, causing her to hit her head on a coffee table. He told police he had only tried to move her.He admitted that he had pushed her and made no reference to having done so to defend himself. The woman sued for her injuries in the District Court, and the court awarded her $163,786.   The Defendant appealed to the Supreme Court.

The Supreme Court upheld the District Court’s decision to reject the self-defence claim, dismissed the appeal, confirmed the original judgment amount, and ordered him to pay the costs of the appeal. This was a good outcome for the abused victim.

If you have been the victim of an assault, domestic violence or otherwise, you may have a claim for compensation.  Any compensation awarded can include an amount for pain and suffering, past and future loss of income, past and future medical expenses as well as costs.
