In a case which came before the NSW Court of Appeal, a woman was assaulted in her home by her de-facto partner by him grabbing, shaking and pushing her causing her to fall back and strike her head on a coffee table. He agreed to the police that they had had an argument but said when he tried to move her she fell over and hit her head. He admitted that he had pushed her and made no reference to having done so to defend himself. The woman sued for her injuries in the District Court and was awarded $163,786. The Defendant appealed to the Supreme Court.
The Supreme Court determined that the District Court was entitled to reject the allegation of self defence and dismissed the appeal, and confirmed the judgement amount awarded and further ordered that he pay the cost of the Appeal. This was a good outcome for the abused victim.
